When we refer to "@The Net Lounge" throughout our site, we are refering to thenetlounge.com.au and/or @The Net Lounge Pty Ltd.

Upgrades performed @The Net Lounge are done in order to install and operate linux and/or execute 'Homebrew' code on the consoles. As the intent is NOT to run any copyrighted material, it can be seen that the upgrades are not overcoming a "technological protection measure" that prevents or inhibits the infringement of copyright, as homebrew and/or linux are opensource and not subject to copyright.

In fact we @The Net Lounge will go so far as to say that you should not copy any material, that you are not the legal copyright owner of, to your upgraded console.

This means that the upgrades are NOT a circumvention device as defined under the relevant Act as the upgrade is only enhancing the console to perform a use for which it was not intended.

Xbox upgrades are installed with the Cromwell bios which is NOT based upon any copyrighted Microsoft code and is free to use under a public license and remains totally legal.

@The Net Lounge we accept NO liability for what you, the customer, does with the Xbox and upgrade once completed.

There is nothing to suggest that owning and using an upgraded console (even to play import/backup games!!) is illegal.

By purchasing an upgrade @The Net Lounge, you agree that the usage of this product is strictly your responsibility, and you also agree that @The Net Lounge Pty Ltd is not responsible for any use/misuse of any product.

Due to the fact that upgrades completed or provided @The Net Lounge are able to be reflashed we cannot accept any responsibility for the legal status of any bios provided.

Manufacturer Warranty:  As soon as we open up the case on your console, your warranty from Microsoft is voided.
